Terms of Service

These Terms of Service ("Terms") govern your access to and use of Callsmith's website and AI receptionist service (the "Service"), operated by Callsmith ("we", "us", "our"). By using the Service, you agree to these Terms.

1. Using the Service

You must be authorised to act on behalf of the business you register, and to provide accurate account information. You're responsible for activity that occurs under your account, including maintaining the confidentiality of your login credentials.

2. Call handling & your responsibilities

Callsmith answers, qualifies, and books calls on your behalf based on the scripts and settings you configure. You are responsible for:

  • Reviewing and approving the call scripts and booking rules used for your account.
  • Complying with any laws that apply to call recording and disclosure in your jurisdiction, including notifying callers where required.
  • The accuracy of business information (hours, service area, pricing) provided to Callsmith to relay to callers.

3. Subscription & billing

Plans are billed monthly or annually as selected at sign-up. Fees are non-refundable except where required by law. You may cancel at any time; cancellation takes effect at the end of your current billing period. We may change plan pricing with advance notice.

4. Acceptable use

You agree not to use the Service to:

  • Violate any applicable law or regulation.
  • Harass, deceive, or defraud callers or third parties.
  • Attempt to interfere with or disrupt the Service or its underlying infrastructure.
  • Resell or provide the Service to third parties without our written consent.

5. Intellectual property

Callsmith and its logos, software, and branding are owned by us or our licensors. These Terms don't grant you any rights to our intellectual property beyond what's needed to use the Service as intended.

6. Service availability

We aim to keep the Service available and reliable, but we don't guarantee uninterrupted access. We may suspend or modify the Service for maintenance, security, or legal reasons, and will provide notice where practical.

7. Limitation of liability

To the extent permitted by law, Callsmith is not liable for indirect, incidental, or consequential damages arising from your use of the Service, including lost revenue from missed or mishandled calls, except where caused by our gross negligence or wilful misconduct.

8. Termination

We may suspend or terminate access to the Service for breach of these Terms, non-payment, or conduct that risks harm to Callsmith, our other customers, or their callers.

9. Changes to these Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
